Terms of Service

1. Agreement to Terms

By accessing or using ListedIn AI ("the Service"), operated by ListedIn AI ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.

2. Description of Service

ListedIn AI is a diagnostic intelligence platform that scans AI language models (including ChatGPT, Google Gemini, and Anthropic Claude) to measure how your business appears in AI-generated responses. We provide visibility scores, competitor analysis, perception summaries, and trend tracking.

We do not optimize, influence, or guarantee your visibility in any AI model. AI outputs are determined by each model's training data and algorithms, which are outside our control. Our service is purely diagnostic — we show you what AI models say, we do not change what they say.

3. Accounts

To use the Service, you must create an account using a valid email address or Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old to create an account. You agree to provide accurate information and to update it as needed.

4. Free and Paid Plans

The Service offers a free tier and a paid "Pro" subscription tier.

• Free tier: Limited to one AI model scan (ChatGPT), 2 scans per business, 1 business per account, and basic reporting features.
• Pro tier ($29/month): Multi-model scanning (ChatGPT, Gemini, Claude), unlimited scans (subject to fair-use limits), scheduled scans, full competitor intelligence, PDF reports, and extended data retention.

Fair-use limits apply to all plans to protect infrastructure. These include per-project scan cooldowns, daily scan caps, and rate limiting. These limits are designed to be invisible to normal usage patterns.

5. Billing, Cancellation, and Refunds

Pro subscriptions are billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

All sales are final. You may cancel your subscription at any time from your Account page or through the Stripe Customer Portal. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No partial refunds or prorated credits will be issued for unused time.

If payment fails, your account will enter a 3-day grace period during which Pro features remain accessible. After the grace period, your account will revert to the free tier.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to interfere with, compromise, or disrupt the Service
• Use automated scripts, bots, or scrapers to access the Service beyond normal usage
• Circumvent usage limits, rate limiting, or access controls
• Create multiple accounts to circumvent free-tier limits
• Resell, redistribute, or white-label the Service or its outputs without written permission
• Misrepresent AI visibility scores or reports as guarantees of AI performance

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by ListedIn AI and protected by applicable intellectual property laws.

Scan results, reports, and data generated by the Service for your account are yours to use, share, and distribute. However, the underlying scoring algorithms, prompt templates, and analysis methodologies remain our proprietary property.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

You may export all your data at any time from your Account page. You may delete your account at any time, which will archive your scan data and permanently delete your authentication credentials.

9. Third-Party Services

The Service integrates with third-party platforms to provide its functionality:

• OpenAI (ChatGPT) — AI model scanning
• Google (Gemini) — AI model scanning
• Anthropic (Claude) — AI model scanning
• Stripe — Payment processing
• Supabase — Authentication and data storage
• Resend — Transactional email delivery
• Google Analytics — Usage analytics

Each third-party service is governed by its own terms and privacy policies. We are not responsible for the availability, accuracy, or behavior of third-party AI models.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• AI visibility scores will be consistent across time or models
• AI model responses will be accurate, complete, or current
• The Service will be uninterrupted or error-free
• Scan results will translate to business outcomes

AI models change their outputs frequently due to retraining, updates, and algorithmic changes. Visibility scores are snapshots, not guarantees.

11. Limitation of Liability

To the fullest extent permitted by law, ListedIn AI and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Account Termination

You may delete your account at any time from your Account page. We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.

Upon termination, your scan data will be archived and your authentication credentials will be permanently deleted. Any active subscription will be cancelled.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Minnesota.
